Foodstick Return & Refund Policy

Effective Date: April 1, 2022

Any capitalized terms used but not defined below shall have the meaning assigned to them in the Terms of Use, which govern your use of our website www.foodstick.online (the "Website") and our 'Foodstick' mobile and handheld application (the "App"). The "Platform" refers to both the website and the application.

  1. Customer Cancellation

    In general, Customers are not permitted to cancel orders once they have been placed. Only before the order is processed can the Customer choose to cancel it. However, based on Customer's previous cancellation history, Foodstick reserves the right to refuse any reimbursement to Customer resulting from a cancellation initiated by Customer, even if the Order is being processed and the account is being suspended, as Foodstick deems necessary in its sole discretion.

    If Customer cancels his or her Order after it has been processed, Foodstick has the right to collect a penalty of 100% of the Order amount as compensation for the damages suffered by Foodstick, with the option to either not refund the Order value if Customer's Order is prepaid or recover from Customer's subsequent Order if Customer's Order is postpaid, to compensate the Merchants and PDPs.

  2. Non-Customer Cancellation

    Foodstick reserves the right to collect a penalty for the Orders constrained to be cancelled by Foodstick for reasons not attributable to Foodstick, including but not limited to:

    • If the address given by the Customer is incorrect or falls outside the delivery zone;
    • Failing to contact Customer by phone or email at the time of Order delivery;
    • Failure to deliver Customer Order owing to a lack of information, direction, or authorization from Customer at the time of delivery; failure to deliver Customer Order due to a lack of information, direction
    • At the time of booking the Order, all of the items bought by the Customer were unavailable;
    • At the time of booking the Order, all of the items bought by the Customer were unavailable. Foodstick will call the Customer via the phone number supplied to us at the time of placing the Order if an item in the Order is unavailable. In this case, Customer will be able to cancel the entire Order and receive a refund of up to 100% of the Order value.
    • In the case of dine in and take way order, if the merchant cancel the order, the customer will get upto 100% refund according to the individual merchant restaurant policy. Foodstick will not be responsible for individual merchant restaurant policy.

    Foodstick shall not collect any penalty from the Customer in the event of cancellations due to circumstances attributable to Foodstick, the Merchant, or the PDP.

  3. Refunds

    For prepaid Orders, the customer may be entitled to a refund. Foodstick reserves the right to deduct the penalty owed by the Customer in Section I(2) from the refunded amount. The Customer is also entitled to a proportionate refund if the packing of an item in an Order, or the entire Order, is tampered with or destroyed, and the Customer refuses to accept delivery for the reason stated;

    If PDP fails to fulfill the Order owing to a cause attributable to either PDP or Foodstick, the Customer may be entitled to a refund of up to 100% of the Order value; however, such reimbursements will be considered on a case-by-case basis by Foodstick.

    Our refund decision will be final and binding.

    All refund amounts will be credited to Customer's account as specified in the payment mechanism of Customer's choosing, with a 5-10 business day turnaround time.

    Customer will not be required to pay for the following items if payment is made at the time of delivery:

    1. Orders delivered with tampered or damaged packaging; 
    2. Wrong Orders delivered; or 
    3. Items missing from the Customer's Order at the time of delivery.

    If the same is informed to Foodstick Customer Care via the Platform before the Order is marked as delivered, the Order will be marked as delivered.
